In South Africa, staff employment is controlled by the Basic Conditions of

Employment Act7.

Since employers are legally responsible for ensuring the safety of their

workplace, they obviously want to know who they are hiring. This is one of the

reasons behind the upswing in demand for criminal record and credit checks.

Accordingly the Act permits potential employers to ask applicants if they have

criminal records and request details if the answer is yes. However, any decision

not to employ the candidate has to be related to the conviction.

In other words, the conviction must show that the person would constitute a

threat to the company. The law does not however allow prospective employers to

enquire about arrests that did not result in convictions and it also does not permit

questions on pending cases since in South Africa a person is presumed innocent

until proven guilty.

Cliffe Dekker then notes that in terms of the King Report, a company’s board is

responsible for ensuring that the company has implemented an effective ongoing

process to identify risk, measure its potential impact against a set of

assumptions, and then activate what it believes is necessary to proactively

manage these risks.

The board should therefore decide on what risk that company is prepared to take

and what risks it will not take in pursuance of its goals and objectives. Further,

risk assessment should address the company's exposure to, among other risks,

those in the form of human resources risks.

because it cannot be forgotten, misplaced, or stolen. Fingerprint authorization is

potentially the most affordable and convenient method of verifying a person’s

identity.

The lines that create a fingerprint pattern are called ridges and the spaces

between the ridges are called valleys. Its is through the pattern of these ridges

and valleys that a unique fingerprint is matched for verification and authorization.

The service is provided by means of live scanning of the fingerprint with the

results available within 48hours.

The scanning is conducted at your office/premises. This system eradicates all

unnecessary paperwork and allows for a fast efficient service .

Hard-copy fingerprint can be delivered at our offices – or can be picked up

from your offices/premises at an additional travelling cost.

The equipment needed to conduct the searches is portable, and can

therefore be used at any of our sites ( conditions apply).

All fees for example maintenance etc are included in the initial or monthly rental

fee.

 The complete system (scanner, PC/notebook, software etc.) will be installed by

AFISCLEAR (conditions apply).

Training the system operators will be provided by AFISCLEAR.
